Terms and Conditions for Nisuda Counseling

1. Introduction

Welcome to Nisuda Counseling (“we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your use of our website (Nisuda.com) and our online psychological counseling services (“Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

2. Services Provided

Nisuda Counseling offers online psychological counseling services. Counseling sessions typically last between 90 to 120 minutes and can be scheduled at a frequency of once a week, twice a week, or once every two weeks. No other services such as workshops or webinars are offered at this time.

3. Eligibility

To use our Services, you must be at least 18 years old. By using our Services, you represent and warrant that you meet this eligibility requirement.

4. Account Registration

Account registration is not required to use our Services.

5. Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. There are no specific guidelines or rules for users during counseling sessions.

6. Payment and Fees

Our Services are subject to fees, which are 100% prepaid. We offer a free welcome call (15-20 minutes) to determine if there is a mutual fit. If a user is not satisfied with a session or cannot attend, they are entitled to a 100% refund or can reschedule the session. Sessions can be canceled or rescheduled with at least five days’ notice before the scheduled time.

7. Confidentiality and Privacy

8. Disclaimer of Warranties

Our Services are provided “as is” and “as available,” without any warranties of any kind, either express or implied. The psychologist does not guarantee that the process and the results of the counseling will meet your expectations. All results are the consequences of your own decisions and actions, and you bear full and sole responsibility for them. You can terminate the counseling at any time without explanation. You confirm that you are not registered at psychiatric institutions or with a psychiatrist and do not have any mental disorders or diagnoses.

9. Limitation of Liability

To the fullest extent permitted by law, Nisuda Counseling shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use our Services; (b) any conduct or content of any third party on our Services; (c) any content obtained from our Services; and (d) unauthorized access, use, or alteration of your transmissions or content.

10. Indemnification

You agree to defend, indemnify, and hold harmless Nisuda Counseling, its affiliates, and their respective officers, directors, employees, agents, and advisors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of our Services.

11. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Users can terminate their engagement with us by notifying us via mail. We will also notify users of termination privately during a session or by mail.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Japan for the purpose of litigating all such claims or disputes.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our website. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.

All content on our website is owned by Nisuda Counseling. The method “Progress Psychology” is copyrighted by its creator, Oleg Lekontsev, who is my teacher.
